Driver convicted of causing deadly school bus crash requests new trial

CLARK COUNTY — The man convicted of causing a deadly school bus crash in Clark County in 2023 is now requesting a new trial.

In court documents obtained by News Center 7, Hermanio Joseph asked the court to “reverse his decision and remand for a new trial in an impartial venue.”

Joseph was found guilty of involuntary manslaughter and vehicular homicide in May 2024. He was sentenced to nine to 13.5 years in prison that same month.

Joseph is now arguing that he didn’t get a fair trial and that it should have been moved out of Clark County.

His lawyers argue that the court “abused its discretion and created structural error when it denied Joseph’s motion for a change of venue.” They claim his rights to due process and to a fair trial by an impartial jury were violated.

His legal team also argues that Joseph was “denied his right to effective assistance of counsel.”

As News Center 7 previously reported, Joseph was on trial after he crashed a van into a Northwestern Local Schools bus on the first day of school in August 2023. 11-year-old Aiden Clark was on the bus and died in the crash. Dozens of other students were hurt in the crash.

Joseph did not have an Ohio driver’s license, nor one from any other U.S. state at the time of the crash.
